A. A person may give donated food material to the owner, or the owner’s legally designated representative, of a qualified animal operation.

B. Responsibility of Owner; Animal Health.

1. It shall be the responsibility of the owner, or the owner’s legally designated representative, of a qualified animal feeding operation to ensure that such donated food material meets Osage Nation’s animal health feeding standards.

2. Failure of owner or representative to comply with these standards shall not subject the donor of donated food material to liability for damages arising from such failure.

3. A person shall not be subject to civil or criminal liability arising from the nature, age, packaging, or condition of donated food waste that the person donates in good faith to a nonprofit organization for ultimate distribution to a qualified animal feeding operation.
