A. The Osage Nation Department of Natural Resources (DNR) shall have the authority to develop regulations and other authorities to carry out the provisions of this chapter pursuant to ONCA 17-35.

B. DNR must be allowed to enter and inspect the premises to ensure compliance with these rules. If DNR determines that the farmer is not in compliance with these rules, DNR will provide the farmer notice of the requirements that have not been met.

C. If a farmer fails an inspection, the farmer will have thirty (30) days from the date the notice was sent to submit a written response that demonstrates how the deficiencies have been corrected. A farmer is also required to inspect and assess adjacent lands for possible sources that might contaminate the production field and take corrective actions if needed.

D. DNR can schedule a second inspection to ensure the farmer is in compliance. After the second inspection, DNR can issue violations for any deficiencies that were not remedied. ONCA 21-40, eff. Apr. 28, 2021.
