A. Any person over whom the Nation possesses criminal jurisdiction who intentionally violates any provision contained in this Act may be criminally prosecuted in the Trial Court of the Osage Nation and, upon conviction, may be incarcerated for a period of up to one year or fined up to Five Thousand Dollars ($5,000.00) or both.

B. Any person or entity over whom the Nation may not assert criminal jurisdiction who intentionally violates any provision contained in 13-109 of this Title may be sued in the Trial Court of the Osage Nation and, upon a judgment of liability, may be assessed a civil fine of up to Five Thousand Dollars ($5,000.00) per violation and may be further subject to an order permanently excluding such person or entity from transacting business with the Osage Nation.

C. Nothing in this section shall be deemed to prevent the Nation from prosecuting or seeking prosecution of any person or entity for violation of any other provision of law or bringing a civil action against such person or entity for any remedy that may be available under contract or tort law.

D. A violation of any provision contained in this Act shall be deemed grounds for removal of an Osage Nation official; immediate termination of employment of an Osage Casino employee; or the rescission of any contract.

E. In addition to all other penalties and sanctions set forth in this section, any violation of Sections 13-109(G) and (H) of this Title shall render the competitive bid proceedings void and require solicitation and reward anew.

F. All bidding documents with the Osage Nation shall contain the following provision:

Any violation of the competitive bidding procedure shall constitute a material breach of this contract and shall entitle Osage Casinos to revoke, rescind, and repudiate this contract. In the event of such material breach of this contract, the Osage Nation shall be relieved of all obligations contained herein and the contractor shall forfeit to the Nation any bond or deposit related to this contract.
