A. The Osage Nation Utility Authority established by this Act is a governmental agency of the Osage Nation, and possesses the privileges and immunities of the Osage Nation, including sovereign immunity from suit. The Authority is not authorized to waive the sovereign immunity of the Nation, nor to waive any right, privilege, or immunity of the Nation. The sovereign immunity of the Osage Nation Utility Authority is expressly retained, except for the limited waiver within this Act for the enforcement of certain Osage Nation court orders.

B. Any waiver of sovereign immunity made for the purpose of providing for the sale and issuance of bonds, warrants, notes or other obligations incurred by the Authority shall be subject to approval by the Osage Nation Congress. ONCA 13-41, eff. Apr. 23, 2013; ONCA 14-43, eff. May 30, 2014.
