A. The civil fines imposed under this section are intended to be remedial and not punitive and are designed to compensate the Nation for the damage done to the peace, security, economy and general welfare of the Nation and to compensate the Nation for damages sustained by the Nation by reason of violations of this Act and the costs incurred by the Nation in enforcing this Act.

B. Any person who violates or fails to comply with any provision of this Act, or who fails, omits, or neglects to obey, observe, or comply with any order, decision, decree, rule, direction, demand, or requirement of the board of trustees acting on behalf of the Authority, or any part or provision thereof, shall be liable for a civil fine not to exceed One Thousand Dollars ($1,000.00) for each violation thereof. Each day during which any such violation of failure to comply continues shall constitute a separate violation of this Act. The amount of the civil fine, when finally determined or agreed upon in compromise, if not paid, may be recovered in a civil action in the Osage Nation Trial Court. ONCA 13-41, eff.
