A. The Osage Nation may, up to a contract price of Three Hundred Fifty Thousand Dollars ($350,000.00), utilize the competitive negotiation procedures prescribed below for procurement of professional services, such as architectural, engineering, surveying services, construction management, construction manager at risk and owner’s representative, whereby competitors are selected, subject to negotiation of fair and reasonable compensation.

1. A request for proposals containing a description of the project and specification is prepared, publicized, and submitted to no less than five qualified sources and all timely responses are considered;

2. At least two formal price quotations including terms and conditions for the desired product or service are received from qualified sources; and

3. The Procurement Officer must provide documentation evidencing that due diligence has been performed based on an objective market analysis sufficient to determine that the selected source is capable and qualified to complete the project and that the proposed cost is fair, reasonable, and customary.
