A. This statute shall apply to all agencies of the Osage Nation unless otherwise provided by specific provisions of law.

B. Nothing in this statute shall operate to amend, alter, revise, change, repeal, supplement, or otherwise affect the Osage Nation Gaming Statute, ONCA 07-09, or the Tax Commission Statute, ONCA 06-10.

C. Nothing in this statute shall effect a waiver of the sovereign immunity of the Osage Nation or any agency of the Osage Nation in any matter, case, or claim for monetary damages; provided, that this statute shall operate to permit a person or entity aggrieved by an agency action or decision and/or to seek equitable relief in Osage Nation courts against the agency if such party has been adversely affected by an action or decision of the agency after having exhausted all administrative remedies.

D. No appeal of any agency action or decision, including the commencement of a legal challenge of any rule or regulation promulgated by an agency, may be brought unless filed within thirty (30) days from the date of the final action or decision or from the effective date of a final regulation; provided, that a party may challenge the lawfulness of a final regulation in defending against an enforcement action or the imposition of sanctions by final order of an agency upon exhaustion of all administrative remedies.
