A. The courts of the Osage Nation shall have appellate jurisdiction over final agency actions and decisions.

B. The Trial Court of the Osage Nation shall have appellate jurisdiction over final actions and decisions of an agency or actions or decision unlawfully withheld under this statute including, but not limited to, licensing and permitting decisions, enforcement actions, directives issued to regulated parties, and the denial of requests made of the agency by a regulated party, except that the courts shall have no jurisdiction over appeals of and actions taken on:

1. Agency decisions to issue, revise, or withdraw a regulation; or

2. A personnel action of an agency in relation to an employee.

C. In furtherance of its jurisdictional responsibilities, the court shall have the authority to:

1. Develop rules and procedures consistent with this statute for processing, hearing, and rendering decisions on appeals subject to its jurisdiction;

2. Receive, process, hear, decide, and/or dismiss appeals made by a regulated party;

3. Render decisions, including its rationale for such decisions; and

4. Maintain records of appeals and its actions with regard to them. ONCA 09-73, eff. Oct. 1, 2009.
