A. Members of the Osage Nation age sixty-five (65) and over may opt out of the limited health benefit and enroll in and receive Medigap coverage Plan F, Plan G and Part D, including deductibles, upon turning sixty-five (65) and in lieu of the full benefits every year thereafter.

B. Medigap coverage applications and change of benefit forms shall be made available to the members of the Osage Nation.

C. The Medicare supplement proceeds may be paid in the form most convenient to the member.

D. Changes that diminish Medigap coverage or delay payments for approved claims shall be presented for approval by the Osage Nation Congress.

E. Over sixty-five (65) members of the Osage Nation electing Medigap coverage shall automatically be reenrolled the following calendar year unless their membership is terminated, there is a relinquishment of the member’s tribal membership, the member opts out, or by death of the member.

F. A third-party administrator shall submit quarterly financial and benefit use reports to the Principal Chief and the Osage Nation Congress. ONCA 18-70, eff. Apr. 25, 2019; ONCA 21-105, eff. Sept. 30, 2021; ONCA 22-108, eff. Sept. 26, 2022.
