A. No person shall interfere intentionally with a lawful investigation of suspected elder abuse or neglect.

B. No person shall retaliate by any means against any person who has made a good faith report of suspected elder abuse or neglect or who cooperates with an investigation of suspected elder abuse or neglect.

C. Any person who violates the provisions of subsection (A) or (B) of this section shall be enjoined from such activity and shall be subject to a civil penalty of up to Five Hundred Dollars ($500.00) per occurrence and shall be guilty of a misdemeanor and upon conviction thereof shall be punished and assessed the penalties as provided by the Osage Nation criminal code1 (and, if an Osage Nation employee, to any appropriate disciplinary action as allowed by the Osage Nation Personnel Policies and Procedures). The penalty shall be assessed by the Court only after petition, notice, the opportunity to be heard, and a determination that either interference or retaliation as set out in this section occurred. Further, notice of such determination shall be provided to the person’s Osage Nation employer and appropriate licensing agencies.
