A. Preference Afforded. Osage employment preference shall be afforded, unless otherwise prohibited by federal law, to a qualified member of the Osage Nation whether the appointment involves initial hiring, contracting, reinstatement, transfer, reassignment or promotion, provided other qualifications are equal.

B. Should any member of the Osage Nation be qualified for any initial hiring, contracting, reinstatement, transfer, reassignment or promotion, the Osage Nation employer must find a compelling reason for not selecting the qualified member of the Osage Nation and shall file a report on such finding with the Department of Human Resources of the Osage Nation, or appropriate human resources authority for the hiring entity. The report shall be considered confidential and a protected record under Osage law.

C. Secondary preference in employment shall be given to persons of Osage descent who are not members of the Osage Nation. ONCA 11-30, eff. Mar. 29, 2011; ONCA 11-105, eff. Oct. 5, 2011; ONCA 23-22, eff. Apr. 11, 2023.
