Any person who is mentally incompetent and/or under the age of eighteen (18) and is entitled to receive benefits under this Act, shall be appointed a guardian or other representative by the Tribal Court if a guardian has not been appointed in a prior action. The guardian or representative so appointed shall be responsible for the filing and prosecution of the claim under this Act. ONCA 12-76, eff. Oct. 1, 2012.
