Subchapter 3 COVERAGE AND COMPENSABILITY

A. Claimants seeking benefits under this Act shall be responsible for filing their claim with the Administrator.

B. Coverage exists under this Act for a worker’s injury without regard to fault or negligence if the claim for bodily injury by incident or bodily injury by disease meets the following criteria:

1. The injury must arise out of and in the course and scope of the injured worker’s employment with the employer; and

2. The activity or condition causing the injury must be necessary or incidental to the employer’s business. ONCA 12-76, eff. Oct. 1, 2012.
