A. The Osage Nation shall establish a protocol with a clear chain of custody from proper collection, to interpretation and review, of all specimens collected for employee and applicant drug testing purposes.

B. All specimens for drug testing shall be referred to an accredited laboratory for analysis. All positive results shall be confirmed using a more specific testing method. All test results shall be submitted, by the laboratory, to a qualified Medical Review Officer who shall be a licensed physician. After review, the Medical Review Officer shall establish the final result of the test and communicate that result to the Osage Nation Human Resources Department. The number and type of drugs tested for shall be set by the Osage Nation Human Resources Department.

C. Any deviation from the protocol meeting the requirements established in this Act shall void the test result. ONCA 15-97, eff. Oct. 7, 2015.
