A. No dispositional order or decree including termination of parental rights and adoption shall divest the child’s traditional custodians or grandparent of their right to reasonable visitation with the child and their duty to provide instruction and training to the child regarding tribal customs and traditions or their duty to provide the necessities of life for the child should the parents be unable to do so, unless those rights and duties have been extinguished in a proceeding in which the individual was a party; provided, that adoptive traditional custodians shall also succeed in these rights and duties.

B. The rights and duties of the traditional custodians and grandparents may be enforced by court order whenever it appears in the child’s best interest to do so; provided, that all parties to the case shall be given notice and an opportunity to be heard.
