Whenever a law enforcement officer or the Indian Child Welfare Department takes a child to a detention or shelter facility, or admits a child to a medical facility and determines not to release said child, the officer or Indian Child Welfare Department worker who took the child to a detention or shelter facility shall notify the Court, at the earliest opportunity, that the child has been taken into custody and where he or she has been taken. A brief written report shall be filed with the Court stating the facts which led to the child being taken into custody and the reason why the child was not released. This report shall be filed within twenty-four (24) hours excluding Saturdays, Sundays and legal holidays.
