The ONCSS may not initiate enforcement proceedings against an obligor who is currently receiving tribal or state TANF or an obligor who is determined by a medical professional to be disabled and not able to work because of physical or mental health problems. If an obligor is not able to work because of a physical or mental health problem, he or she shall provide the documentation to the Trial Court or ONCSS. The obligor shall provide documentation of a treatment plan that provides a time period the obligor will be unable to work and shall provide documentation that he or she has applied with the Social Security Administration for disability determination and the State Department of Rehabilitation Services.
