No motorcycle, designed to travel with fewer than three wheels in contact with the ground, nor all-terrain vehicle shall be operated with more than one person thereon except that a motorcycle may be operated with not more than two persons riding thereon, if it is designed specifically for the purpose of carrying more than one person in which event a passenger may ride upon the permanent and regular seat if desired for two persons, or upon another seat attached firmly behind the operator. Any driver who violates this section will be charged with an infraction and pay a fine not to exceed Fifty Dollars ($50.00).
