A. There is hereby established in the Treasury a revolving fund, not subject to fiscal year limitations, which shall be designated the “Capital Asset Fund.”

B. Appropriation requests for capital funding shall be accompanied by a budget and detailed cost estimate documents if applicable:

1. Capital construction project funding requests shall include a conceptual design if the project cost is over One Million Dollars ($1,000,000.00) and architectural and engineering renderings if the project cost is over One Hundred Thousand Dollars ($100,000.00), all pre-construction activity if not previously funded and detailed total cost estimate of the project, including but not limited to furniture, fixtures, and equipment, landscaping, sidewalks and parking lots.

2. Pre-construction activity funding requests shall include a detailed cost estimate of all activities performed within the scope of the activity.

3. Capital asset purchase funding requests shall be accompanied by a detailed cost estimate.

C. All capital asset purchases and capital construction projects receiving capital funding shall be conducted under all applicable provisions of the Osage Nation Competitive Bidding Act, 15 ONC § 2-401 et seq., and conform to the procurement policy of the Osage Nation Treasury Department.

D. The assets of the Capital Asset Fund shall consist of monies appropriated to it by act of the Osage Nation Congress.

E. Residual assets remaining in the Capital Asset Fund may be authorized for new or additional capital assets expenditure by an act of Congress, the Osage Nation Treasurer shall verify in writing the available funds.

F. The Osage Nation Treasurer is vested with the authority to authorize expenditures out of this fund consistent with the appropriation request for capital funding and the purpose stated in and the purpose stated in Section 6-101 of this Title.
