A. There is hereby established in the Treasury a revolving fund for the burial assistance program, not subject to fiscal year limitations, for the purpose of assisting members of the Osage Nation and their families with funeral costs.

B. The fund established by this section shall be designated the “Burial Assistance Fund.”

C. The assets of the Burial Assistance Fund shall consist of monies appropriated to it by Act of Congress and donations.

D. Expenditures out of the Burial Assistance Fund with or on behalf of Osage members shall be limited to assistance through individuals or entities who contract with the burial assistance program, and any associated administrative costs.

E. All funds for burial assistance shall have the following priority for payment:

1. Payment for the actual cost of burial or cremation;

2. Reimbursement for advance payment of costs for burial or cremation services;

3. Payment of or reimbursement for cemetery monuments or markers, or cremation urns;

4. Reimbursement of verified costs incurred for last rites, flowers, receptions, meals not to exceed the remainder of funds after payment of other items in this section.

F. The Burial Assistance Fund shall exist until the fund is terminated by Act of the Osage Nation Congress. ONCA 11-121, eff. Sept. 27, 2011.
