A. Only the Osage Nation government and individuals who are members of the Osage Nation or their legal entities principally owned and operated by individuals who are members of the Osage Nation, and who meet the requirements of subsection (C) of this section, shall be eligible to register motor vehicles and to receive tags under this Title.

B. The Tax Commission shall furnish a written statement to each applicant for motor vehicle registration or motor vehicle tag, or renewal thereof, which reads as follows:

If you do not possess an Osage membership card or Osage Nation employee identification, your Osage Nation tag and registration may be considered invalid by the Oklahoma Tax Commission. Therefore, if or when the vehicle is reregistered with the State of Oklahoma (vehicle traded or sold to a non-Indian), back fees and penalties may be assessed. Additionally, if pulled over by local or Oklahoma state law enforcement authorities for any reason, you may be asked to show your Osage Nation employee identification or Osage Nation membership card and if without such identification your car may be impounded and you may be cited to appear before local or Oklahoma state courts to answer to local or Oklahoma state or local offenses under the laws of those jurisdictions.

C. Excepting the Osage Nation government, the Tax Commission shall require the following when applications for registration of motor vehicles are presented:

1. The vehicle owner must surrender the vehicle owner’s title or the dealer documentation of sale and any documentation of a lien entry or notice of a third-party security interest to the Tax Commission.

2. The vehicle owner must either present the current year’s registration notification or make the subject vehicle available to verify the tag and decal number.

3. The vehicle owner must complete a vehicle registration application which, under penalty of perjury, the owner discloses that he or she owns the vehicle and that he or she is a member of the Osage Nation.

4. Except as provided in Section 4-105(B) of this Title, evidence that the owner resides within the confines of the areas of the state that constitute the Osage Nation Reservation or former Indian reservation lands in Oklahoma (“Indian country”).

5. The vehicle owner must present a valid Osage Nation membership card and government-issued photo I.D. issued to the vehicle owner.

6. The vehicle owner must present an original insurance verification form evidencing automobile insurance covering the registered vehicle for liability coverage for not less than the minimum requirement of the State of Oklahoma, or Ten Thousand Dollars ($10,000.00) bodily injury to or death of any person in any one accident, Twenty Thousand Dollars ($20,000.00) bodily injury to or death of two or more persons in any one accident, and not less than Ten Thousand Dollars ($10,000.00) because of injury to or destruction of property or other in any one accident, whichever amount is greater.
