Part 4 RIGHTS OF THIRD PARTIES

This part is included in your selections.
This section is included in your selections.

Whether a debtor’s rights in collateral may be voluntarily or involuntarily transferred is governed by law other than this Osage Nation Secured Transactions Act; however, an agreement between a debtor and secured party which prohibits a transfer of the debtor’s rights in collateral or makes the transfer a default does not prevent the transfer from taking effect. This section is subject to 27A ONC § 9-404, which invalidates certain legal and contractual restrictions on transferability that generally would be effective under other law. ONCA 07-22, eff. June 18, 2007.
