A. Any person who trespasses in a building, structure, or conveyance while there is a human being in the building, structure, or conveyance at the time the offender trespassed, attempted to trespass, or was in the building, structure, or conveyance commits the criminal offense of trespass in an occupied building, structure, or conveyance.

B. Any person convicted of committing the criminal offense of trespass in an occupied building, structure, or conveyance shall be guilty of a crime punishable by imprisonment in the Tribal jail for not less than thirty (30) days nor more than six months, by a fine in any sum not less than One Hundred Dollars ($100.00) nor more than Five Hundred Dollars ($500.00), or both such fine and imprisonment.
