A. Any person who is armed with a firearm or other dangerous weapon or arms himself or herself with such while trespassing in an occupied building, structure, or conveyance commits the criminal offense of armed trespass in an occupied building, structure or conveyance.

B. For the purpose of this section, it shall be immaterial whether the offender was aware a person was occupying the building, structure, or conveyance.

C. Any person convicted of committing the criminal offense of armed trespass in an occupied building, structure or conveyance shall be guilty of a crime punishable by imprisonment in the Tribal jail for a period not to exceed two years, a fine in an amount not to exceed Ten Thousand Dollars ($10,000.00), or both such imprisonment and fine.
