A. Any person who willfully removes, destroys, mutilates, or commits any act designed to remove, mutilate, or reduce the legibility or effectiveness of any posted notice placed by the owner, tenant, lessee, or occupant of legally enclosed or legally posted land pursuant to any law of this Nation for the purpose of legally enclosing the same shall be guilty of committing the crime of unlawful tampering with posted notice.

B. Any person convicted of committing the criminal offense of unlawful tampering with posted notice shall be guilty of a crime punishable by imprisonment in the Tribal jail for a period not to exceed thirty (30) days or a fine in an amount not to exceed One Thousand Dollars ($1,000.00), or by both such imprisonment and fine; and, in addition, the court shall order restitution for actual damages incurred.

C. Any person convicted of a second or subsequent offense of unlawful tampering with posted notice shall be punished by a fine in any sum not less than One Thousand Five Hundred Dollars ($1,500.00) nor more than Two Thousand Five Hundred Dollars ($2,500.00), or by confinement in the Tribal jail for not less than thirty (30) days nor more than six months, or by both such fine and imprisonment; and in addition, the court shall order restitution for actual damages incurred.
