Any individual, corporation or other person who:

A. Makes or possesses any instrument, apparatus, equipment, or device designed, adapted or which can be used:

1. To fraudulently avoid the lawful charge for any telecommunication service in violation of 6 ONC § 1-148; or

2. To conceal, or to assist another to conceal, from any supplier of telecommunication service or from any lawful authority the existence or place of origin or of destination of any telecommunication; or

B. Sells, gives or otherwise transfers to another, or offers or advertises to sell, give or otherwise transfer, any instrument, apparatus, equipment, or device, described in subsection (A) of this section, or plans or instructions for making or assembling the same; under circumstances evidencing an intent to use or employ such instrument, apparatus, equipment, or device, or to allow the same to be used or employed, for a purpose described in subsection (A)(1) or (A)(2) of this section, or knowing or having reason to believe that the same is intended to be so used, or that the aforesaid plans or instructions are intended to be used for making or assembling such instrument, apparatus, equipment, or device;

shall be deemed guilty of a misdemeanor, and shall, upon conviction thereof, be imprisoned in the Tribal Jail not exceeding one year or fined not exceeding One Thousand Dollars ($1,000.00), or both, in the discretion of the Court. ONCA 13-25, eff. Apr. 19, 2013.
