A. Any person or agent of that person who solicits another person or persons to cause the death of a human being by the act of murder in the first degree, as is defined in Section 2-113, shall be guilty of committing the criminal offense of solicitation for murder in the first degree.

B. Any person who is convicted of committing the criminal offense of solicitation for murder in the first degree, except as provided in Section 2-113, shall be guilty of a crime punishable by imprisonment in a Tribal Jail for not less than one year nor more than three years, or by a fine not to exceed Ten Thousand Dollars ($10,000.00), or by banishment for a period not less than five years nor more than life, or any combination of the above.
