A. Any person who, with intent to kill, administers or causes or procures to be administered to another any poison which is actually taken by such other person but by which death is not caused shall be guilty of committing the criminal offense of attempted lethal poisoning.

B. Any person convicted of committing the criminal offense of attempted lethal poisoning shall be guilty of a crime punishable by imprisonment in the Tribal Jail not exceeding three years, or by a fine not exceeding Fifteen Thousand Dollars ($15,000.00), or by both such fine and imprisonment.
