A. Vehicular homicide” means the killing of a human being, or the killing of an unborn child by any injury to the mother, caused by the operation of a motor vehicle by another in a reckless manner likely to cause the death of, or great bodily harm to, another.

B. Any person who commits vessel homicide, as defined herein, shall be guilty of committing the criminal offense of vehicular homicide.

C. Any person convicted of committing the criminal offense of vehicular homicide shall be found guilty of a crime punishable by imprisonment in the Tribal Jail not exceeding two years, or by a fine not exceeding Ten Thousand Dollars ($10,000.00), or both; provided, however, a person shall be found guilty of a crime punishable by imprisonment in the Tribal Jail not exceeding three years, or by a fine not exceeding Fifteen Thousand Dollars ($15,000.00), or by both, if:

1. At the time of the accident, the person knew, or should have known, that the accident occurred; and

2. The person failed to give information and render aid as required under this chapter. ONCA 22-33, eff. Apr. 25, 2022.
