ASSAULT AND BATTERY

A. Battery” means any willful and unlawful use of force or violence, or actually and intentionally offensive touching or striking of another person against the will of or without the consent of the other.

B. Any person that commits battery, as defined herein, shall be guilty of committing the criminal offense of battery.

C. Any person convicted of committing the criminal offense of battery shall be guilty of a crime punishable by imprisonment in the Tribal Jail not exceeding one year, or by a fine of not more than Five Thousand Dollars ($5,000.00), or by both such fine and imprisonment.
