A. Assault” shall mean an intentional, unlawful threat by word or act to do violence to the person of another, coupled with an apparent ability to do so, and doing some act which creates a well-founded fear in such other person that such violence is imminent.

B. Any person that commits assault, as defined herein, shall be guilty of committing the criminal offense of assault.

C. Any person convicted of committing the criminal offense of assault shall be guilty of a crime punishable by imprisonment in the Tribal Jail not exceeding thirty (30) days, or by a fine of not more than Five Hundred Dollars ($500.00), or by both such fine and imprisonment.
