A. As used in this section, “flammable substance” means gasoline, petroleum products, or flammable liquids with a flashpoint of one hundred fifty (150) degrees Fahrenheit or less.

B. Any person who willfully and maliciously places or throws, or causes to be placed or thrown, upon the person of another, any vitriol, corrosive acid, flammable substance, or caustic chemical of any nature, with the intent to injure the flesh or disfigure the body of that person, is guilty of committing the criminal offense of battery by placing or throwing vitriol, corrosive acid, flammable substance, or caustic chemical of any nature.

C. Any person convicted of committing the criminal offense of battery by placing or throwing vitriol, corrosive acid, flammable substance, or caustic chemical of any nature is guilty of a crime punishable by imprisonment in the Tribal Jail for a period not to exceed two years, or by a fine in the amount of Ten Thousand Dollars ($10,000.00) or by banishment for a period not to exceed five years, or any combination of the foregoing penalties.
