The judge to whom any child pornography, or any obscene material, is delivered pursuant to this section shall, upon the examination of the accused, or if the examination is delayed or prevented, without awaiting such examination, determine the character of such child pornography or obscene material, and if the judge finds it to be obscene material or child pornography, the judge shall cause the same to be delivered to the Attorney General of the Osage Nation. The judge shall issue in writing the factual and legal basis for the determination by the judge of the character of the child pornography or obscene material. ONCA 22-33, eff. Apr. 25, 2022.
