A. Every physician who being in the state of intoxication administers any poison, drug or medicine, or does any other act as such physician to another person, is guilty of committing the criminal offense of intoxicated physician.

B. Any person convicted of committing the criminal offense of intoxicated physician shall be guilty of a crime punishable by imprisonment in the Tribal Jail for a term of not more than one year, and by a fine in an amount not more than One Thousand Dollars ($1,000.00). In addition, the defendant shall be ordered to make restitution to any victims in an amount as determined by the court. ONCA 22-33, eff. Apr. 25, 2022.
