A. Any person who intentionally and wrongfully shoots another or discharges any kind of firearm, with intent to kill any person, including an unborn child, shall be guilty of committing the criminal offense of shooting or discharging firearm with intent to kill.

B. Any person convicted of committing the criminal offense of shooting or discharging firearm with intent to kill shall be guilty of a crime punishable by imprisonment in the Tribal Jail for not more than three years, by a fine of up to Fifteen Thousand Dollars ($15,000.00), or banishment for a period not to exceed ten (10) years, or any combination of the foregoing penalties.
