A. Any person who uses any vehicle to facilitate the intentional discharge of any kind of firearm, crossbow or other weapon in conscious disregard for the safety of any other person or persons, including an unborn child; or any driver or owner of any vehicle, whether or not the owner of the vehicle is occupying the vehicle, who knowingly directs any other person to discharge any firearm from the vehicle; or any occupant of any vehicle who knowingly and willfully discharges any firearm from the vehicle within one thousand (1,000) feet of any person shall be guilty of committing the criminal offense of use of vehicle to facilitate discharge of weapon in conscious disregard of safety of others.

B. Any person convicted of committing the criminal offense of use of vehicle to facilitate discharge of weapon in conscious disregard of safety of others shall be guilty of a crime punishable by imprisonment in the Tribal Jail for a term not less than one year, by a fine of up to Five Thousand Dollars ($5,000.00), or by banishment for a period not to exceed three years, or any combination of the foregoing penalties.
