A. Any person who perpetrates any unlawful throwing, projecting, placing, or discharging of a destructive device or bomb that results in any bodily harm to a person, regardless of intent or lack of intent to cause such harm, commits the criminal offense of unlawful throwing, projecting, placing, or discharging of destructive device or bomb that results in injury to another.

B. If any individual commits a violation of this provision during the commission of another crime, the violation of this provision may be charged independently and in addition to the other criminal offense.

C. Any person convicted of committing the criminal offense of unlawful throwing, projecting, placing, or discharging of destructive device or bomb that results in injury to another shall be guilty of a crime punishable by imprisonment in the Tribal Jail for a term not less than one year or by a fine not to exceed Five Thousand Dollars ($5,000.00), or both.
