A. Any person who perpetrates any unlawful throwing, projecting, placing, or discharging of a destructive device or bomb that results in great bodily harm, permanent disability, or permanent disfigurement to a person, regardless of intent or lack of intent to cause such harm, commits the criminal offense of aggravated unlawful throwing, projecting, placing, or discharging of destructive device or bomb that results in injury to another.

B. If any individual commits a violation of this provision during the commission of another crime, the violation of this provision may be charged independently and in addition to the other criminal offense.

C. Any person convicted of committing the criminal offense of aggravated unlawful throwing, projecting, placing, or discharging of destructive device or bomb that results in injury to another shall be guilty of a crime punishable by imprisonment in the Tribal Jail for a term not more than two years, or by a fine not to exceed Ten Thousand Dollars ($10,000.00), or by banishment for a period not to exceed ten (10) years, or any combination of the foregoing penalties.
