A. As used in this section:

1. Enabling aggravated child abuse” means the causing, procuring or permitting of a willful or malicious act of aggravated child abuse, as defined in this chapter, of a child under eighteen (18) years of age by another.

2. Permit” means to authorize or allow for the care of a child by an individual when the person authorizing or allowing such care knows or reasonably should know that the child will be placed at risk of abuse as proscribed by this section.

B. Any parent or other person who willfully or maliciously engages in enabling child abuse commits the criminal offense of enabling aggravated child abuse.

C. Any person convicted of committing the criminal offense of enabling aggravated child abuse shall be punished by imprisonment in the Tribal Jail not exceeding three years, or by a fine not exceeding Fifteen Thousand Dollars ($15,000.00), or by both such fine and imprisonment.
