A. Any person who in the presence of any child indulges in any degrading, lewd, immoral or vicious habits or practices, or who is habitually drunk or under the influence of illicit substances in the presence of any child in his care, custody or control, commits the criminal offense of unlawful habitual practices in presence of child.

B. Any person convicted of committing the criminal offense of unlawful habitual practices in presence of child shall be guilty of a crime punishable by imprisonment in a Tribal Jail for not more than six months, or by a fine not exceeding Five Hundred Dollars ($500.00), or both.

C. Nothing in this section shall preclude prosecution under any other provision of law. ONCA 22-33, eff. Apr. 25, 2022.
