A. Any parent of any child or children under the age of ten (10) years, and every person to whom such child or children have been confided for nurture or education, who deserts such child or children within the Osage Nation, or takes such child or children without the Osage Nation, with the intent wholly to abandon the child or children, commits the criminal offense of desertion of children under age of ten (10) a crime.

B. Any person convicted of committing the criminal offense of desertion of children under age of ten (10) a crime shall be guilty of a crime punishable by imprisonment in the Tribal Jail for not more than one year, by a fine not to exceed One Thousand Dollars ($1,000.00), or both.
