A. Any woman who knows she is not pregnant but who holds herself out to be pregnant, or any person that holds out another as being pregnant but knows the individual is not pregnant, and offers to place a child upon birth for adoption shall be guilty of committing the criminal offense of fraudulent offer for adoption.

B. Any person convicted of committing the criminal offense of fraudulent offer for adoption shall be guilty of a crime punishable by imprisonment in the Tribal Jail not to exceed one year, or by a fine not to exceed One Thousand Dollars ($1,000.00), or by banishment for a period not less than one year nor more than life, or any combination of the above.
