A. Any person who obtains or attempts to obtain financial benefits with the intent to receive those financial benefits where there is an intent to do either of the following: (1) not complete the adoption; or (2) not consent to the adoption; shall be guilty of committing the criminal offense of fraudulent solicitation for adoption.

B. Any person convicted of committing the criminal offense of fraudulent solicitation for adoption shall be guilty of a crime punishable by imprisonment in the Tribal Jail for a term not exceeding one year or by a fine not exceeding Two Thousand Five Hundred dollars ($2,500.00), or both.
