A. The term “false imprisonment” means forcibly, by threat, secretly confining, abducting, imprisoning, or restraining another person without lawful authority and against her or his will.

B. Confinement of a child under the age of thirteen (13) is against her or his will within the meaning of this section if such confinement is without the consent of her or his parent or legal guardian.

C. Any person who commits false imprisonment commits the criminal offense of false imprisonment.

D. Any person convicted of committing the criminal offense of false imprisonment shall be guilty of a crime punishable by imprisonment in the Tribal Jail for a period not to exceed two years or by a fine not to exceed Ten Thousand Dollars ($10,000.00), or both. ONCA 22-33, eff. Apr. 25, 2022.
