A. Upon conviction of committing failure to restrain or contain canine, the Tribal Court may order the offender to pay restitution to the victim or victims for any damages caused by the dangerous dog.

B. The owner or owners of any dog shall be liable for damages to the full amount of any damages sustained when his dog, without provocation, bites or injures any person, domestic animal, or livestock while such person is in or on a place where the person, domestic animal, or livestock has a lawful right to be.

C. Conviction of the crime of failure to restrain or contain canine shall not be a prerequisite for finding the owner of a canine liable in a civil action. ONCA 22-33, eff. Apr. 25, 2022.
