A. Any person who willfully fails to report the presence or discovery of human skeletal remains or what they believe may be human skeletal remains within forty-eight (48) hours to the Osage Nation Police shall be guilty of a crime punishable by a fine not to exceed One Thousand Dollars ($1,000.00), or by a term of imprisonment in Tribal Jail not to exceed one year, or both.

B. Any person who knowingly disturbs human skeletal remains or associated funerary items other than a law enforcement officer, a representative of the Office of the Chief Medical Examiner, a professional archaeologist, or physical anthropologist, shall be guilty of a crime punishable by a fine not to exceed Five Thousand Dollars ($5,000.00), or by a term of imprisonment in Tribal Jail not to exceed three years, or both.
