A. It shall be unlawful for a parent, guardian or other person having physical charge of a minor to allow said minor under the age of eighteen (18) years to be away from his place of residence in a public place, or a private place other than the place where he intends to spend the night with the permission of the owner of such place, or in a vehicle driving about, after the hour of 11:00 p.m. local time, unless accompanied by a parent, guardian or other person having physical charge of said minor or in attendance at or returning directly home from an organized school, church, tribal or public function.

B. A curfew violation shall be punishable by a fine not to exceed Two Hundred Fifty Dollars ($250.00) or by a term of imprisonment in the Tribal Jail not to exceed three months, or both.
