A. Any violation of a provision of this Act by a sex offender who is an Indian shall be considered a crime and subject to a maximum penalty of one year imprisonment and/or a fine of Five Thousand Dollars ($5,000.00), or by banishment for a period not less than five years nor more than life; or any combination of the above.

B. Any violation of a provision of this Act by a sex offender who is not an Indian shall be considered a civil violation subject to enforcement by any means not prohibited by federal law, including but not limited to the issuance of fines, forfeitures, civil contempt, and banishment.

C. All violators of this Act may be subject to additional penalties imposed by a state or the federal government. ONCA 11-43, eff. Apr. 5, 2011.
