§ 5-502. Definitions.
For this subchapter, “crime victim” shall have the following meaning:
A. In General. The term “crime victim” means a person directly and proximately harmed due to the commission of a crime listed in the Osage Nation Code and to which the Osage Nation Trial Court has jurisdiction.
B. Minors and Certain Other Victims. In the case of a crime victim who is under eighteen (18) years of age, incompetent, incapacitated, or deceased, the legal guardians of the crime victim or the representatives of the crime victim’s estate, family members, or any other persons appointed as suitable by the Court may assume the crime victim’s rights under this subchapter, but in no event shall the defendant be named as such guardian or representative.
C. Excluded. The term “victim” shall not include the accused or any person whom the Court finds would not act in the best interests of a deceased, incompetent, minor, or incapacitated victim. ONCA 24-47, eff. Apr. 19, 2024.
