A. The Osage Nation Historic Preservation Office as established within the Executive Branch is hereby charged with the authority to carry out the purpose and policies of this chapter and its regulations.

B. The Tribal Historic Preservation Officer and all other subordinate positions shall be subject to the merit-based system of employment as defined by Osage law.

C. The Osage Nation Historic Preservation Office is granted the authority to draft, promulgate, and implement regulations as the Osage Nation Historic Preservation Office deems necessary to promote cultural preservation and regulate the protection and preservation of the Osage’s ancestral lands and items of cultural patrimony. All rules and regulations promulgated by the Osage Nation Historic Preservation Office shall not be final until published and noticed pursuant to the Administrative Procedures Act, 15 ONC § 2-801 et seq.

D. The Principal Chief shall assign, grant authority, and declare such other policies relating to the administration and implementation of this Act as necessary to protect and promote the traditional Osage culture through the departments and offices of the Osage Nation government.
